What rights do I have under the TCPA?
The TCPA prohibits marketers from robocalling or texting you without your permission. It also requires them to give you a way to opt out of communications. If you opt out, they must respect your preference and stop contacting you.
The Federal Trade Commission maintains a National Do Not Call Registry. Even if your name and number(s) are on that list, you may still get calls from scammers who ignore the registry or legitimate businesses if you’ve given them permission to contact you.
I keep getting robocalls or spam texts. What should I do?
Keep evidence of your request for them to stop contacting you – including the date and manner of your opt-out request. If they keep contacting you, save the texts and phone call information so you have documentation should you pursue a legal claim. In the case of phone calls, try to find out the name of the company that is calling you. Ask to speak to a manager or someone who can provide that information.
What if I keep getting calls and texts from debt collectors?
Another federal law – the Fair Debt Collection Practices Act (FDCPA) – places limits on when and how debt collectors can contact you. If they have violated your rights, you may have a separate claim for compensation under the FDCPA.
